If payment is not made on a Negotiable Instrument when it is due, the holder can use the court system to enforce the instrument. Holder in Due Course is a person who takes a ngo for value, in good faith, and without notice that it is defective or is overdue. A holder who does not qualify as an HDC under the Shelter Principle may not be able to obtain HDC status.
