Renato Perez and the deceased Diosdado Viojan were attacked by appellant Pajares and his companions on their way to a store. Pajares hit Viojan with a baseball bat, killing him. While Pajares claimed the mitigating circumstance of immediate vindication for a previous attack on his brother 10 hours earlier, the court found the 10 hour interval was sufficient for Pajares to have recovered his serenity, so this mitigating circumstance did not apply to lessen his culpability.
