The city of Aurora issued $50,000 in bonds to the Ohio and Mississippi Railroad Company to purchase stock in the company. The bonds were sold to West & Torrence. When interest payments were not made, West & Torrence sued the city multiple times in state and federal courts. In this case, the city argued the judgments should not be used as estoppel and that the bonds lacked consideration. The court found the issue of consideration could have been raised in earlier suits and upheld the previous judgments again
