What is Beyond Human: Smart-contracts, Smart-Machines, and Documentality about?

Documentality is a theory of social reality proposed by philosopher Maurizio Ferraris. Barry Smith and David Koepsell have previously written about some of the theory’s shortcomings in accounting for edge cases, specifically where social objects arise and may continue to exist without any ‘inscriptions’, and how computers have complicated the notion of inscriptions in general. In this chapter, the technology of smart contracts is described as providing additional challenges to documentality, but the theory of documentality is proposed as suggesting some sound design principles for smart contracts and the digital objects that may yet be possible where documents become computable and even potentially, true artificial agents. Legal rules and classifications will require adjustment to account for the manners of existence of the social objects and agents that are considered, and references to elements of documentality are potentially important for such a framework.
