What is Bail Discretion in Ugandan Law about?

The Constitutional Court of Uganda addressed the issue of whether courts have discretion to grant or deny bail under Article 23(6) of the Constitution. The court concluded that while an accused has the right to apply for bail, the court has discretion to grant or refuse bail based on the circumstances of each case. However, if the accused has been in custody for the specified time limits, the court must grant bail as per Articles 23(6)(b) and (c).
