What is Cundy v Lindsay: Contract Void Due to Fraud about?

Lindsay & Co sold linen handkerchiefs to a man using a fraudulent identity. The man then sold the goods to Cundy. Lindsay & Co sued Cundy to recover the goods. The lower court ruled that Cundy acquired the goods bona fide and could keep them. However, higher courts found that as there was no actual agreement between Lindsay & Co and the fraudulent man, title to the goods never passed to him and therefore he could not pass title to Cundy. The goods had to be returned to the original owners, Lindsay & Co.
